Agreed Order of Referral to Arbitration

This Court has examined the Joint Motion for Referral to Arbitration and is of the opin­ion that the motion should be granted. The Court finds that this case is appropriate for alterna­tive dispute resolution in accordance with chapter 154 of the Texas Civil Practice and Remedies Code, and the case is referred for [binding/nonbinding] arbitration under section 154.027 of the Texas Civil Practice and Remedies Code, the Texas General Arbitration Law (chapter 171 of the Texas Civil Practice and Remedies Code), and [section 6.601/section 153.0071/sections 6.601 and 153.0071] of the Texas Family Code. IT IS ORDERED that [name of arbitrator] is appointed an impartial arbitrator who is qualified for family law alter­native dispute resolution under section 154.052 of the Texas Civil Practice and Remedies Code.

IT IS ORDERED that this case shall be submitted to [binding/nonbinding] arbitration on or before [date].

IT IS ORDERED that the fees and costs for the arbitration shall be divided and borne equally by the parties, shall be paid in advance by the parties directly to the arbitrator, and shall be taxed as costs. Each party and counsel will be bound by the Family Law Arbitration Agreement and Family Law Arbitration Rules provided by the arbitrator. Each party and counsel are ORDERED to cooperate with the arbitrator.

IT IS ORDERED that the parties proceed with arbitration and that all parties, counsel, and the arbitrator shall be present during the entire arbitration process. Counsel, the parties, and the arbitrator shall agree on an arbitration date and location within thirty days of the date this order is signed. If no agreed date and location can be scheduled within the next thirty days, IT IS ORDERED that the arbitrator shall select a date and location within sixty days of the date this order is signed, and all parties and counsel are ORDERED to appear as directed by the arbitrator.
