Arbitrator’s Initial Letter

[Date]

[Names and addresses of attorneys for both parties]

Re:    [style and cause number of case]

[Salutation]

In response to your inquiry about my availability to serve as arbitrator, I suggest that we meet in my office at a mutually agreeable time and have a preliminary conference about the parties and the nature of the case. This discussion will enable us to set the rules and procedures for arbitration and to determine whether there is any present or potential disqualification for me to serve as arbitrator.

Arrangements concerning my fees and disbursements should be made and agreed on before the employment begins. To that end, I am enclosing the Arbitrator’s Fees and Disbursements Agreement that establishes the terms and conditions for my compensation if you and your clients decide to employ me. If the terms and conditions are acceptable to you and your clients, please have your clients sign the agreement and tender their respective checks for the appropriate retainer.

For preliminary information to your clients, I am also attaching a copy of my resume.

If the fee contract is approved and signed by your clients, it will be incorporated as an integral part of the Family Law Arbitration Agreement.

I will contact you to set the date of our preliminary meeting.

Sincerely yours,
