The Texas Municipal Retirement System has promulgated the following simplified, preapproved qualified domestic relations order. Together with instructions, it may be found at 34 Tex. Admin. Code § 129.13. However, this version may not be suitable for all cases and may not provide for the division agreed to by the parties. The Texas Municipal Retirement System allows for different methods of division, and, depending on the method chosen, the benefits awarded can sometimes change significantly. It is important to understand the difference before agreeing to a division and drafting the qualified domestic relations order.
Checking with the retirement system to obtain any available current model forms and instructions is recommended.
