Effective June 1, 2024, the use of certain standardized protective order forms promulgated by the Office of Court Administration (OCA), including this Temporary Ex Parte Order, is required. Tex. Fam. Code § 83.007(a); see also Acts 2023, 88th Leg., R.S., ch. 1037, § 11 (S.B. 48), eff. June 18, 2023. This form is also accessible on the OCA Standardized Protective Order Forms page found at www.txcourts.gov/rules-forms/standardized-protective-order-forms. Practitioners are encouraged to review the OCA’s website for updates, additional instructions, and other relevant forms.
For the OCA’s Additional Orders for Protective Order, which includes supplemental orders that a court may include to tailor the order to the facts of a particular case, see form 17-24.
Note: A court’s failure to use the standardized temporary ex parte protective order as required under subsection 83.007(a) does not affect the validity or enforceability of the protective order issued. Tex. Fam. Code § 83.007(b). See form 17-27 for the Texas Family Law Practice Manual’s original version of a temporary ex parte protective order [and order setting hearing].
