Nonparty Translator Confidentiality Agreement

This form is executed in connection with mediation with [name of mediator], Mediator, in the mediation of a dispute between [names of parties], the parties to this case, [style of case]. This agreement is entered into by the undersigned in consideration of Mediator’s agreement that the undersigned may participate in mediation. Accordingly, the undersigned agrees to the following:

1. I am attending mediation to provide translation services at the request of [name of party]. I understand that it is my duty to disclose any conflicts or associations with all parties and attorneys.
2. I understand that mediation is confidential, and I agree to be bound by section 154.053(c) of the Texas Civil Practice and Remedies Code, which provides: “Unless the parties agree otherwise, all matters, including the conduct and demeanor of the parties and their counsel during the settlement process, are confidential and may never be disclosed to anyone, including the appointing court.”
3. I acknowledge and agree that I am bound to the confidentiality of the mediation process and that I will not discuss, publish, or otherwise disclose the substance, negotiations, or communications that occurred during mediation with anyone, other than the party identified in paragraph 1, after mediation without the written consent of all parties to this case.
4. I understand that I may be subject to monetary damages or sanctions if I violate this agreement.
