The form of an affidavit for business records is addressed in rule 902(10) of the Texas Rules of Evidence. An unsworn declaration may be used in lieu of that affidavit. See section 8.58 of the practice notes. The business records and the declaration must be served on each other party to the case at least fourteen days before the trial begins. See Tex. R. Include the following notice if a minor is named in the caption or if the declaration contains other unredacted sensitive data. See § 6 of the Introduction in volume 1 of this manual concerning protection of sensitive data in filed documents. |
